Terms of Use

These Terms of Use ("Terms") form an agreement between you and Textualy ("we", "us") governing your use of the Textualy application for iPhone, iPad and Mac ("the App"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and the Usage Rules in Apple's App Store Terms. This license is for your personal, non-commercial use.

2. Restrictions

You agree not to: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile or disassemble the App except to the extent permitted by law; (c) rent, lease, lend, sell, redistribute or sublicense the App; or (d) use the App in any unlawful manner or in violation of these Terms.

3. Subscriptions and auto-renewal

The App may offer a free trial and paid auto-renewing subscriptions to unlock full access. The following applies to any subscription:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel subscriptions, and turn off auto-renewal, in your device's App Store account settings after purchase.
  • If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.

All prices, billing periods and offers are shown in the App at the point of purchase and may vary by region. Purchases and refunds are handled by Apple in accordance with Apple's policies; we do not process payments directly.

4. The App is provided by us, not Apple

You acknowledge that these Terms are between you and us only, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

5. Intellectual property

The App, including its design, content, and trademarks, is owned by us or our licensors and is protected by law. Fonts and other third-party components are used under their respective licenses (for example, Space Grotesk and Space Mono under the SIL Open Font License). No rights are granted to you except as expressly stated in these Terms.

6. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will meet your requirements. Textualy is an educational tool and does not guarantee any particular learning outcome.

7. Limitation of liability

To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising out of or related to your use of or inability to use the App. Our total liability for any claim relating to the App shall not exceed the amount you paid for the App, if any, in the twelve months preceding the claim.

8. Termination

This license is effective until terminated. It will terminate automatically if you fail to comply with these Terms. Upon termination you must stop using and delete the App. Sections that by their nature should survive termination will survive.

9. Governing law

These Terms are governed by the laws of the jurisdiction in which the developer is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence apply. [Governing jurisdiction to be specified by the developer.]

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above and post the updated Terms on this page. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
